Kentucky families get NOTHING in state funds, and the barrier is constitutional rather than merely political - a three-strike history: (1) the 2022 tax-credit scholarship program was struck down by the Kentucky Supreme Court; (2) Amendment 2, which would have permitted such funding, was rejected by voters in Nov 2024 by 65.1% to 34.9%, nearly 2-to-1; (3) the 2022 charter school law was invalidated in February 2026. The KY constitution restricts state funding to 'common schools.' THE ONE DEVELOPMENT: House Bill 1 requires the Secretary of State to annually opt Kentucky into the FEDERAL ECCA program, and the legislature overrode Gov. Beshear's veto on March 17, 2026. Because ECCA is funded by private donations rather than state appropriations it routes around the state constitutional bar. Caveat: as of July 2026 Kentucky was reportedly still to complete the IRS filing - re-verify. Any benefit begins in 2027 at the earliest.
